NOTE 1: This bail schedule does not apply to felonies, domestic violence (ORC 2919.25), violation of a CPO, SPO, CRPO, SSOOPO, TPO, DVTOP (ORC 2919.27) or assault (ORC 2903.13), aggravated menacing (ORC 2903.21), menacing by stalking (ORC 2903.211), menacing (ORC 2903.22), aggravated trespass (ORC 2911.211), criminal damaging or endangering involving a family or household member (2909.06) or criminal mischief involving a family or household member (2909.07). In such cases the Judge will want to issue a protection order and will set bail at the initial appearance in Court or by special entry signed by the Judge if the initial appearance in Court will not occur within 48 hours of arrest. The affidavit to establish probable cause for a warrantless arrest and/or information to establish bail should be faxed to the Fostoria Police Department (419-435-9754) for the Judge's consideration if the initial appearance will not occur within 48 hours of arrest. The Judge will fax a judgment entry back to the law enforcement agency setting forth the Court's finding regarding probable cause and/or setting bail within the 48 hour period.

NOTE 2: In misdemeanor cases, where a person is arrested without a warrant or with a warrant when bail is not specified, and subject to the exceptions set forth in NOTE 1 above, the officer in charge of the facility to which the person is brought may issue summons and release the person on his/her personal recognizance instead of requiring him/her to post bond (Crim R. 4(F) and 46(D)). If the person is released then he/she should be given a Court date of Monday at 10:00 A.M. for non-traffic cases or Tuesday or Thursday at 9:00 A.M. for traffic cases.

NOTE 3: The $25.00 is a Statutory Surcharge. It is in addition to 10% cash deposit or surety bond.
